Mr. Iserson advised that the focus on the amount of office footage is because the applicant
first applied for zoning approval as an office use.

A discussion ensued among the Commissioners whether or not a new category should be
added or whether this application is found to be a similar business. Commissioners Wright,
Finch and Michelotti would rather grant a similar conditional use permit than create a new
category in the ordinance. Commissioner Hovingh stated his vision that the downtown core
should be revenue generating retail business with work done on site. Mr. Iserson agreed that
this was the policy expressed in the Specific Plan, and was one of the reasons for staff s
concern with the use on Spring Street.

Chairman McGuirk stated his appreciation for the applicant's work on the application, but he
believes the main thrust of the business is a storage area for a drive-out business. Therefore,
he is not in support of the business.

A motion was made by Commi......ioner Wright, seconded by Commi......ioner Mahem,
making the determination that a landscape business, with an office and on-site storage
of trucks and equipment, is a conditional use similar to "janitorial services and supplies"
in the C-C (Central Commercial) District.

Commissioner Michelotti expressed her concern for approving as a similar use a business
that could possibly be called a nonconforming use in the future.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Michelotti, Mahern, and Wright
Commissioner Hovingh and Chairman McGuirk
None
None

Resolution No. PC-94-18 was entered and adopted determining the landscape
maintenance business as a conditional use.

7. MATTERS INITIATED BY COMMISSION MEMBERS

Commissioner Wright brought forth again that the ATM lights on the Bank of America are
still glaring to street traffic. Also, regarding a neighbor complaint of a boat parked on the
street. Commissioner Wright advised the boat is parked on the street around the corner on
Villa de la Cruz. Mr. Beougher advised the police are to be called for street enforcement.

Commissioner Mahern questioned when the appointments would be made to the Planning
Commission. It was advised the appointments would be made on May 3rd by the City
Council.

Planning Commission Minutes

Page 15

April 13. 1994
