<br />{.. PUBLIC HEARINGS <br /> <br />~ <br /> <br />~ UP-93-63. Best of Seconds <br />Application for a conditional use pennit to operate a secondhand store within an <br />existing building located at 234 Main Street. Zoning for the proberty is C-C (Central <br />Commercial) Core Area Overlay, Civic Overlay, and DowntownrRevitalization District. <br /> <br />Mr. Swift presented the staff report recommending approval of Casq UP-93-63, subject to <br />the conditions of approval in Exhibit "B." Mr. Swift advised the P~ing Commission that <br />the applicant feels the store should be considered a retail store and i , therefore, already in <br />compliance with the Code. Staff has determined this store to be a ondhand store, <br />although outwardly it looks like a retail store and would be a benefi to the downtown area. <br /> <br />Staff raised the issue of whether or not the Planning Commission w~shed to initiate a Code <br />change to establish a new consignment store category. <br /> <br />Mr. Swift also advised that the Downtown Owners Association had fontacted the City <br />recommending approval of this application. i <br /> <br />In response to Chairman McGuirk's question of whether the Plannif. Commission should <br />view the application as a secondhand store or as a retail store, Mr. wift stated that staff had <br />determined it was a secondhand store. However, the Planning Com ission could make a <br />determination that the applicant is not a secondhand store; therefore the Planning <br />Commission would take no action on the use permit. : <br /> <br />Mr. Swift explained that the difference between the Best of Secondsi and a donation store <br />(such as Hope Hospice) is their method of sale. They sell secondh~d items on consignment <br />and split the proceeds with the previous owner. They also differ in Ithat the Best of Seconds <br />accepts clothing only at scheduled appointments whereas a donation istore accepts <br />items/donations of all kinds at any time they are open. <br /> <br />A discussion ensued between Mr. Swift and Commissioners Mahern and Wright about the <br />differences of a secondhand store, a consignment store and an antiq1!Ie store. Staff reiterated <br />that the Planning Commission could make changes to the Code by aUding new categories of <br />approved stores. <br /> <br />PUBLIC HEARING WAS OPENED. <br /> <br />The applicant was not present, and no one chose to speak for or ag~nst this application. <br /> <br />PUBLIC HEARING WAS CWSED. <br /> <br />Commissioner Finch does not feel the applicant should be classified I as a retail store and does <br />not want to add new categories to the Code.
