At that time staff would decide the most appropriate way t accomplish the
separation.

Commissioner Finch believes this particular design does not warran having two addresses.
Mr. Swift stated that since the house has two entrances, it needs to ave two addresses.

In response to Commissioner Michelotti's question of how a perm
be made, Mr. Swift stated that staff would look at the proposed pi
complied with the second unit requirements. Further, the owner w
the modification on the use permit as well as a building permit.

nt division of the units
s to make sure they
ld have get approval of

Chairman McGuirk inquired how the conditional use permit require
communicated to a future new homeowner. Commissioner Wright'
information is stated on the deed when purchasing the property.

ents would be
dicated that such

PUBLIC HEARING WAS OPENED.

Sallie Caraballo, 1740 l50th Ave., San Leandro, represented the ap lication. Ms. Caraballo
stated she had read the staff report and conditions, and she and her other, who is a co-
owner of the project, agree to the conditions.

Ms. Caraballo indicated the staff report (page 2) was in error in tha she would be occupying
the primary unit and her mother, Doris, would be occupying the ndary unit.

~

Robert Morgan, 4957 Forest Hill Drive, Pleasanton, is a neighbor the applicant, and he
feels this application is a way of getting a duplex into an otherwise gle family
neighborhood. He feels that, in the future, the second unit could be turned into a daycare
facility, etc. He wishes to maintain the neighborhood as single fami y homes. Furthermore,
because of another incident in the neighborhood where a resident bu It living quarters over a
garage, Mr. Morgan would like the Commission to honor his feelin s against this
application.

Commissioner Michelotti advised Mr. Morgan that State law does al ow and encourages this
type of development of additional housing, and this particular appli tion is directed by State
law. Other applications for "granny flats" have been brought forw ,and they have been
approved because the State law allows it. Moreover, it is not in the urview of the Planning
Commission to deny an application solely based on the fact that it is a secondary unit.

Mr. Morgan stated he has no objection to the "mother's unit," but fi Is the design of the
house should not include two entrances. He feels this will lower his property value in the
future because of having a multiple unit next door.

Commissioner Hovingh advised Mr. Morgan that the two entrances d two addresses are for
safety reasons so emergency personnel can respond to the appropria entrance. Mr. Morgan
felt this was not justifiable in this instance because there is access to 1 parts of the house
from either entrance. Commissioner Wright added that the State gui e1ines call for it to be
double addressed.

Planning Commission Minutes

Page 3

September 22, 1993
