<br />Commissioner Hovingh asked Mr. Higdon where the contaminated <br />run under Foothill to Moller Park. Mr. Higdon responded that he w <br />contaminated soil, there is construction fill and deposits of material 0 <br />indicated that the spill was in the extreme northeast corner of the p <br />been satisfactorily cleaned at this time. <br /> <br />THE PUBLIC HEARING WAS RE-OPENED. <br /> <br />was located and did it <br />not aware of <br />the site. He prefers to leave Condition 5 as s f recommended. In <br />his opinion, the estimated legal costs are probably the same as woul be incurred to <br />landscape and put in a new gate. He believes that the firelpolice s are valid reasons for <br />putting the gate at the edge of the road. Commissioner Wright preti s the second gate at the <br />property line, which is the open space area. As to Condition 17, he is in favor of changing <br />the wording to relate to the Fish and Game report. <br /> <br />Commissioner Mahern stated that she liked the idea of townhomes ore than single family <br />clustered homes, however, she is very impressed with the design of e houses and can <br />support that part of the PUD modifIcation. Regarding the easement, Commissioner Mahern <br />supports the staff recommendations as far as the conditions and acce s. The first gate should <br />remain where it is and the second gate should be moved to the pr rty line. She <br />encourages the developer to work with the property owners and pos Obly contribute toward <br />helping them improve the access road so it is not a substandard road However, she does not <br />want to mandate this or make it a condition of this PUD. Furtherm re, Commissioner <br />Mahern would not like to see two accesses on Foothill Rd so close gether, thus she would <br />like to see Dr. Glenn's easement be eliminated. The minor inconve 'ence to Dr. Glenn will <br />be outweighed by the benefIt of having a signalized access to the pr ~ect. Regarding the <br />developer's request for changes to Condition 12 regarding contributi ns to the School <br />District, Commissioner Mahern feels that it is standard policy and ey are not being singled <br />out to give more over and above other projects. Furthermore, Com . ssioner Mahern <br />doesn't want the City to pay the cost of eliminating the easement an it should be borne by <br />the developer, as well as the undergrounding of utility lines. She is in favor of amending <br />Condition 17 to either having it worked out by staff and the develo r or be consistent with <br />Fish and Game. Commissioner Mahern also concurs with the chan e to Condition 27 <br />regarding no individual driveway access to new lots on Foothill Ro . <br /> <br />Commissioner Michelotti expressed concern about the reduction of ide to side open space <br />from the townhomes to the single family homes from 50 to 10 feet. Because of the <br />marketability of single family homes, she is supporting the change the PUD.
