<br />Commissioner Mahern stated that she disagreed with the other Co missioners and felt that <br />since any new applications would have to be considered on a case- y-case basis, that their <br />concern was inappropriate for the situation. She reminded them th t the same logic could <br />have applied to the approval of granny flats, but that again, each is figured on an <br />individual basis. She noted that Mr. Myers had a good point as to ho would monitor the <br />number of clients that go to Ms. Mullen's unit, stating that it woul be up to the neighbors to <br />monitor the situation and if it becomes a problem to notify the Plan ing Department. At this <br />point the use permit would be in jeopardy. She felt they should gi the applicant an <br />opportunity to get her business started and stated that she supported the project. <br /> <br /> <br />In response to Commissioner Michelotti's question, Mr. Swift repli that should the <br />Commission approve the application that the homeowners' associati n has the option of then <br />going to civil court. <br /> <br />Commissioner Wright stated he would prefer this type of occupatio not be in a home at all, <br />but would consider approval if a time limit such as a year were im sed. At the end of that <br />period, the applicant would have to go into a commercial location. <br /> <br />Chairman Hovingh would also prefer that the application be establis ed in a business <br />location; he would definitely not want therapeutic massage services ushrooming up in <br />individual homes. <br /> <br />A motion was made by Commissioner Mahern, seconded by Co . ioner Michelotti <br />making the required conditional use ("mdings and approving Cas UP-92-68, subject to <br />the conditions listed in Exhibit "B", with the following modificati n: <br /> <br />o Add Condition 8 that the use pennit may run for 0 e year, at which time <br />the applicant must reapply for a pennit. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Mahern, Michelotti, Wright nd Chainnan Hovingh <br />Commissioner McGuirk <br />None <br />None <br /> <br />Resolution No. PC-93-10 was entered and adopted approving Cas UP-92-68 as <br />motioned. <br /> <br />The Laguna Vista Homeowners' Association was informed that they ave 15 days in which <br />to appeal the decision to City Council. <br /> <br />Planning Commission Minutes February 24, 1993 <br /> <br />Page 5 <br />
