<br />Item S.c. i m <br />Application to subdivide an approximately 91-acre site into SS s' <br />one, approximately 4l-acre open space lot located at 8015 Foo ' Road, Zoning for the <br />property is PUD (Planned Unit Development) - Rural Density R 'dential/Low Density <br />Residential District, <br /> <br /> <br />Mr. Swift presented the staff report recommending that the Commis <br />deny Vesting Tentative Map Tract 6563; follow Option 3 and direct e applicant to <br />reprocess a new development plan with no houses in the area that w uld be at risk from <br />movement by the ancient landslide. After reading the staff report, . Currin indicated that <br />he would prefer Option 2 which would take those lots as it relates to the lower portion of the <br />project and ask approval of a tentative map for those particular lots. Staff has reviewed <br />building pads that would have to be set back in order to meet the mmendations of the <br />City's reviewing geologist, and with a slight modification to one cul- e-sac at the extreme <br />south end of the project could agree to a plan with 37 lots. Those 1 would be identical <br />where they are currently located except lot 7, which would be mov northward where the <br />cul-de-sac is shortened. Mr. Swift stated that he does have copies 0 the plan should the <br />Commission decide to approve that option. The applicant will also b reviewing the plan. <br />He noted that if this plan is approved the conditions of approval will ave to be either deleted <br />or modified. <br /> <br />A copy of the plan was put on the bulletin board for review. <br /> <br />THE PUBLIC HEARING WAS OPENED, <br /> <br />Jack Smith, 23320 Foothill Boulevard, Hayward, represented the app 'cation. He stated that <br />he appreciates all the work done by staff, but finds no other altemati e but to disagree with <br />the staff report. He, the applicant, architect, and geologists who hav researched the project <br />feel that the ancient landslide is not unstable and that it is entirely to build on. He said <br />their studies have well proven that this ancient landslide is safe. <br /> <br />Jerry Dommer of Dommer and Byars, architect for the project, said e knew the <br />Commission was familiar with the project as they have been before em a number of times. <br />He displayed a rendering of the site and showed where the toe of the ancient landslide is <br />located. This encompassed 11 lots which is called the hill area and lots in another hill <br />section. Option 2 takes lots 44, 45, and 46 and the 11 lots away f the master plan, <br />takes lots 1 and 2, leaving lot 3. It takes lots 4, 5, and 6; lot 7 is in rfacing the toe of the <br />slide and can be saved. Lot 8 was joined with lot 9. <br /> <br />Simon Makdessi, 4384 Indigo Drive, San Jose, CA, stated that he w rks for Terrasearch, <br />Inc. and has done extensive studies on the recent and ancient landslid . He gave some <br />background of the studies done on the site, beginning in 1988.
