Commissioner Finch discussed Mr. Archer's suggestions with Mr. Sift and felt that Mr.
Archer had raised a good issue. Commissioner Finch questioned wh er this situation might
happen again to another developer. Mr. Swift replied that it could h pen again, but is not
the usual thing. Typically, Growth Management approval is good fo about two-and-one-half
years from the time a developer receives approval. The tentative ma is good for two years.
This tentative map was approved within the first six months; therefor, it happened that it
ran out before Growth Management approval. In prior times, all fin maps have been
approved well within the two and one-half year Growth Management eriod. What is
holding up the project is lack of funds to get the fmal map.

In response to Commissioner Finch's concern, Mr. Swift replied that he procedure could be
changed. Discussion ensued; however, the Commission concluded th t if the policy were
changed that it could create problems with Growth Management appr val.

A motion was made by Commk~ioner Wright, seconded by Co 'ioner McGuirk
approving the time extension on Tract 6339 subject to the conditi ns listed in Exhibit B,

ROLL CALL VOTE

-

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Mahern, McGuirk, Michelotti, Wright, and Chairman Hovingh
None
None
None

Resolution No. PC-92-90 was entered and adopted approving Tract 6 39 as motioned.

Item 5,f, T rrin nst i n om an ak F rm
Application to subdivide an approximately 91-acre site into 55 sin Ie-family lots and
one, approximately 41-acre open space lot located at 8015 Foothill Road, Zoning for the
property is PUD (planned Unit Development) - Rural Density Res dential/Low Density
Residential District,

Continued to 11/11/92.

Item 5.l!:. 1 h mi h A i C I w
Application to subdivide an approximately 18,6 acre parcel into 2 lots located at the
southwest corner of the Sunol Boulevard/I-680 intersection, Zo ' g for the property is
PUD (planned Unit Development) - LDR (Low Density Residentia District,

Mr. Swift presented the staff report recommending approval of Tract
the conditions listed in the staff report.
