~ Commissioner Mahern asked Mrs. Ben how she would have felt if r. Salmon would have simply built a tiered deck. She felt that the nature of the lot would aye indicated that some sort of structure should have been anticipated by the neighbors. Mr. Ben replied that if Mr. Salmon had just come and discussed the matter with the neighbors, at everything could have been worked out compatibly. Commissioner Mahern agreed there was something unsettling about having the smoked glass windows in the structure and not knowing whether someone is watc ing or not. She asked Mrs. Ben how she would feel if the structure were not there, but a pa was. Mrs. Ben felt that would not be as bad, but feels the noise factor had the possibili of being obtrusive, especially if parties became noisy. Dorothy Bottorff, 2927 Victoria Meadow Court, also represented th appeal. She said the structure looms over her back yard and kills any privacy she had. he said it is impossible to tell whether someone is watching her through the smoked glass indows. She expressed regret that Mr. Salmon nor his landscaper asked the neighbors how they felt about the plans. ,-- Ron Schneider, 650 Orofino Court, gave some background history f the site. He said it was difficult to understand how a licensed contractor could have bu lt the structure without a permit. He felt it would always devalue the Ben's home. He exp ssed concern that Mr. Salmon did not do what was necessary to comply, but felt that the xpense to Mr. Salmon was not the issue right now. He felt that Mr. Salmon should sue e contractor for the problem. Chairman Hovingh asked Mr. Schneider if he is speaking for hims f or for the homeowners' association. Mr. Schneider stated he is speaking for the homeown s' association; however, they have not had a meeting on the matter. Mr. Salmon, 2943 Victoria Meadow Court, owner of the structure, stated that he appreciated the neighbors' honesty. He further stated that he had never intend to hurt their privacy with the structure or with the smoked glass windows. In fact, it w s his intention that the smoked glass would protect their privacy as well as his. He indica ed he has had several parties in the pavilion, but felt they were very well-behaved with n drinking. Furthermore, in the future, if he should have parties and they become too noisy, he hoped the neighbors would talk to him about them. Mr. Salmon stated that he had hired Mr. Jerez to do the entire pI for the pavilion and Mr. Jerez is here to answer any questions. Mr. Salmon further said th t he is willing to plant any kind of trees they wish; he also did not object to putting some ing in the deed of trust as to removal of the pavilion should it be sold or transferred. Commissioner Wright questioned Mr. Salmon as to whether the p ilion has lights inside.
