<br />~- <br /> <br />Commissioner Wright asked Mr. Salmon for further clarification as how and who handled <br />the pavilion construction. Mr. Salmon stated he paid the spa compan for the pavilion on <br />top of the decking, but hired Mr. Jerez to make sure that everything as done in proper <br />order. He agreed with Commissioner Wright that it was Mr. Jerez's responsibility to install <br />the deck and to make sure that a permit was obtained for the deck an pavilion. <br /> <br />Mr. Jerez came to the podium. <br /> <br /> <br />Commissioner Finch asked Mr. Jerez if he is a licensed contractor, d whether he is <br />licensed to construct buildings and if he has a B-1 license. Mr. Jere responded that he is a <br />licensed contractor and a landscape designer; he did not have a B-1 1 cense to construct <br />buildings. Mr. Jerez said he has a license to landscape which includ s the installation of <br />decking. <br /> <br />Mr. Jerez went on to say that in the last months he has been accused of many things by the <br />City and by other people. He felt that just because his sign might b up on the premises or <br />on his truck that he is responsible for the construction. He felt that j st because his use of <br />English was not the best did not mean anything; he also felt that just because he had moved <br />to Blackhawk that people did not like it. <br /> <br />~ <br /> <br />In response to Commissioner Finch's questioning, Mr. Jerez said he as hired by Mr. <br />Salmon to supervise the entire project. Mr. Jerez stated that he had nstructed the contractor <br />who actually did the construction to get the permit, which he though he had done. He <br />further responded to questioning and stated that he instructed his sub ntractor to go to the <br />Planning Department with plans for the deck, pavilion and the land aping and that he <br />thought it had been approved. However, he stated he did not actual see the permit. <br /> <br />Mr. Beougher stated that the City Attorney and the Planning Depart ent had reported Mr. <br />Jerez to the State Licensing Contractor's Board. They had received a letter stating that after <br />preliminary review Mr. Jerez was in violation of Code 7110, which is performing work <br />without proper permits from the City. He has been reported to the tate Licensing Board <br />and they are dealing with Mr. Jerez. <br /> <br /> <br />Commissioner Finch pointed out to Mr. Jerez that it was his respon bility to make sure his <br />subcontractor actually got the permit; Mr. Jerez agreed that it was h s responsibility and <br />apologized. <br /> <br />Chairman Hovingh stated that the issue tonight is not whether Mr. J rez has a license or not, <br />but whether the pavilion should remain.
