Mr. Swift said he did no know whether the <br />Parks Department had coordinated the event or whether it was done y the Soccer Club. <br />However, he would check into the matter. <br /> <br />Chairman Hovingh called staff's attention to a recent event in the Bes Plaza where a hot air <br />balloon was displayed. He questioned the legality of it, as it was for a single business, not a <br />grand opening of a shopping center. Zonin for the property is <br />PUD (planned Unit Development) - Medium Density Residential istrict. <br /> <br />Mr. Swift presented the staff report which had recommended denial the appeal for Case <br />AP-92-13, upholding the Design Review Board Approval of Case Z- -49, subject to the <br />conditions listed in Exhibit C. Staff feels that privacy can be gained ith a screen of <br />landscape trees along the west boundary; however, a quicker solution to the privacy problem <br />could be achieved by a modification of windows on the west side of e pavilion which faces <br />Orofino Court. With those modifications, staff is recommending app oval to the pavilion. <br /> <br />Commissioner Wright asked whether the applicant or contractor can e penalized after a <br />structure has been built without a permit. Mr. Swift replied that gen rally the penalty would <br />be one-and-a-half or two times the permit fee if the permit is obtain after the fact. <br /> <br />Commissioner Mahern stated she knew the staff report said the appli t was in accordance <br />with the PUD in regard to the required setbacks and the municipal or inance.
