Mr. Owens noted that the situation has raised some concerns from he Val Vista shopping
center owner and tenants in that they are afraid that the Lucky gr ery store might not be
able to remain open if the land use for Site 14a took place. It was his opinion that the
Conditions of Approval would protect Val Vista shopping center. e said that Prudential is
also concerned with being a good neighbor and would not wish to arm the area. If their
request for a land use change is granted, they would work with V Vista tenants to keep any
possible impact low andlor to find a new anchor tenant should Luc store leave.

Commissioner Finch stated he has spoken with Chris Owens about land use change for Site
14a and the Conditions of Approval. He expressed concern that th anchor tenant in Val
Vista would not be able to survive should a land use change allow other market to come in
nearby. He would not like to observe an exchange from one ancho tenant with another
anchor tenant at a different location. However, with the Condition of Approval as they are
stated, he felt the conditions would protect the existing anchor ten t in Val Vista.

Commissioner Mahern spoke with Mr. Owens about the length of e Development
Agreement. Mr. Owens stated that the Development Agreement is lated to be up in the
year 2020. He realized that seemed to be a long time; however, so e of the agreements
with the City in regard to the streets do not end until 2020.

Commissioner Mahern noted that in speaking previously with Mr. wens they had referred
to the Wells Fargo agreement. She wished to remind him that she ad voted against that.

Chairman Hovingh asked if the City has taken possession of all the treets in Hacienda
Business Park, but that Hacienda must still maintain the streets to C ty standards. Mr. Swift
noted the City has taken possession. Hacienda pays a fixed fee, but it is not until 2020 that
they do so for street maintenance. Hacienda is responsible for land ape maintenance within
those streets until 2020 and possibly beyond that.

Commissioner McGuirk asked Mr. Owens what kinds of things Pru ential would and could
do to keep Val Vista from becoming a ghost town. Mr. Owens said Prudential could
actively go out and look for other uses to take over the Val Vista sp ce should Lucky stores
move out. He noted that Mark Sweeney is a broker and has been p -active for a number of
years in this business.

COMMENTS IN OPPOSITION OF APPLICATION
Paul Ebright, 5416 Blackbird Drive, spoke in opposition to the appli tion. He stated that
ten years ago he had vigorously opposed development in Hacienda B siness Park. He felt
that because of his and his neighbors' involvement and opposition, t they had received
some concessions. One of the concessions or conditions was on traf c mitigation measures.
He did not think it was right at this point to tell the citizens that wha was approved ten years
ago can now be changed. He also objected to page 9, number 4 of e Development
Agreement in regard to water mitigation. He concluded by urging t Planning Commission
to reject the application.

Planning Commission Minutes September 9, 1992
Page 6
