<br />Mr. Swift presented the staff report recommending approval of C UP-92-40 subject to the <br />conditions of the staff report. <br /> <br />Commissioner McGuirk discussed with Mr. Swift the definition 0 loitering. Mr. Swift <br />clarified that waiting for a turn at the games would not constitute oitering. Loitering would <br />be more defined as "just hanging around," but not planning to pIa the games. . <br /> <br />Commissioner McGuirk inquired as to whether staff has received y concerns from the <br />surrounding establishments in regard to the arcade. Mr. Swift r lied that staff has not <br />received any feedback at this time. <br /> <br />Commissioner Michelotti asked whether nearby establishments ha <br />replied that in addition to those in the mall, that parties within 3 <br />notified. <br /> <br /> <br />been notified. Mr. Swift advised that <br />staff is agreeable to changing the Conditions of Approval to allo the arcade the same hours <br />as mall operation. <br /> <br />~ <br /> <br />THE PUBLIC HEARING W AS OPENED. <br />Debi Olivero, 3255-1 Scott Boulevard, #102, Santa Clara, CA 95 54, represented the <br />application. She stated she has worked for NAMCO and Atari fi r about ten years. She <br />noted that the operation has been in the US for over ten years an is growing at a rapid pace. <br />She said that NAMCO employees are required to attend extensiv training programs on how <br />to deal with the public, and have over 350 employees nationwide NAMCO is a business <br />that is highly interested in community activities and schools. Th y advertise in local <br />newspapers that they give free games for good grades. She no she also has children who <br />play the games at the arcades, so she is very careful as to how th businesses are run. <br /> <br /> <br />In response to Commissioner Wright's question, Ms. Olivero sta that she concurs with the <br />Conditions of Approval, but would like for the hours of the arca e to coincide with the hours <br />of mall operation. <br /> <br />Commissioner Mahern asked how employees deal with profanity smoking, loitering, etc. <br />Ms. Olivero advised that if the employee sees a problem, the offi nding party is requested to <br />leave. Should the party not cooperate, they then have their own urity force take over. If <br />further assistance is needed, they call the local police department <br /> <br />Commissioner Michelotti questioned Ms. Olivero if they have a onitoring system to check <br />whether youth should be in school or not.
