ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Mahern, McGuirk, Wright, and Chai an Hovingh <br />None <br />Commissioner Michelotti <br />None <br /> <br />Resolution No. PC-92-61 was entered and adopted recommending to Council the exploration <br />of a Sidewalk Improvement District as motioned. <br /> <br />Referral from the Zoninl! Administrator <br />Determination by the Planning Commission as to the conformity f the water diversion <br />and storage proposed by Mannie JoellMartha Greist with the ope space designation in <br />the A-M Homes/GarDlS Ranch PUD-89-13 (4440 Foothill Road). <br /> <br />Mr. Swift presented the staff report recommending the Commission etermine that the <br />proposed use is consistent with the designated open space use approv for this area for Case <br />PUD-89-13. <br /> <br />Chairman Hovingh noted for the record that he had met with Mannie Joel last evening. He <br />pointed out to the public the issue under discussion is a land use issu , not a water rights <br />issue, which would be a civil matter. He called attention to a letter resented to the <br />Commission this evening which staff had received today from Lynn orenson. He noted the <br />concerns of Ms. Sorenson had to do with water rights which is a civi issue, which had also <br />been addressed by Mr. Swift in his presentation. <br /> <br />Commissioner Mahern stated for the record she was pleased that Ch . rman Hovingh gave the <br />Commission time to read the letter which they had just received toni ht. She asked staff <br />whether at the time of the lot line adjustment request, if it was broug t to his attention that it <br />would aid a water diversion. Mr. Swift replied there was an issue wether or not the spring <br />around the property would be used by Mr. Joel. That was obviously one of the reasons why <br />the lot line was drawn as it was. It was known that the spring was g ing to be on the <br />property to be used by Mr. Joel from the Garms' property, and that t some time he would <br />probably attempt to utilize that spring in conjunction with his agricul ral use of the property. <br />At that time it was made clear any use of the property that was zon PUD Open Space <br />would have to conform to that zoning designation. This is the subs uent action to that <br />situation. <br /> <br />Commissioner Mahern asked Mr. Swift what happens to the creek d 'ng a drought, such as <br />the last several years.
