~ Chairman Hovingh asked Ms. Wong when her lease expires. Ms. W ng stated it expires in
1995. She further noted at this point she felt the Planning Departmen should work with the
landlord, not the tenant.

Ms. Vaughn returned to the podium.

Commissioner Mahern stated she understands the City's viewpoint in anting a sidewalk in
the mall areas, but also had a problem with the City coming back no and requiring that a
sidewalk be installed. She asked Ms. Vaughn if the property owner ould be willing to give
a right-of-way.

Ms. Vaughn replied that she did not think the property owner would e willing to pay for the
installation of a sidewalk at this time. The property owner feels that e City does not have
the right to require him to give up his property for a right-of-way, an then also pay for the
improvements. She further noted that even if Ms. Wong finds she ha to leave the premises
because she cannot afford to pay for the sidewalk installation that she would still have to pay
for the lease until in expires in 1995.

Mr. Higdon suggested that the Commission recommend to Council th y set up a Sidewalk
Improvement District as it is desired to get people out of their cars fo short trips.

Ms. Vaughn commented that she manages another complex in Walnut Creek where a similar
situation existed with no sidewalk. She noted CalTrans is going to re ove the landscape
strip, pay for the sidewalk, and pay for installation of the planting of ees, etc., without the
property owners having to pay for anything.

~

THE PUBLIC HEARING WAS CWSED.

Discussion ensued regarding the installation of a Sidewalk Improvem t District. Mr. Swift
suggested the Commission recommend that Council study the matter.

Commissioner Wright felt Condition 7 should be deleted and that it d finitely should not be
up to the tenant to have to convince the property owner to dedicate easement for a
sidewalk. He also felt a sidewalk was not necessary in this area, and that the area is not
even conducive to foot traffic.

Commissioner McGuirk stated he, too, would delete Condition 7. H further felt the
installation of a sidewalk in that area should be worked out by the Ci . He agreed with
staff a sidewalk might be beneficial in directing people to walk on a s dewalk rather than
jaywalk.

Planning Commission Minutes
July 8, 1992

Page 12
