<br />r- <br /> <br />Mr. Swift presented the staff report recommending approval of Case Tentative Tract Map <br />5721 subject to the conditions of the staff report. <br /> <br />In response to Commissioner McGuirk's question, Mr. Swift replied that until the City <br />decides to accept the easement property, it remains private property. When the City accepts <br />the easement, they would then construct a trail and maintain it along with the easement. <br />They would also indemnify and hold harmless the owners' associati from public use of the <br />trail. <br /> <br />Chairman Hovingh noted that they are seeing a number of tentative ap extensions. He did <br />not want to deal with it tonight without a staff report, but wondered hether staff would <br />allow quid pro quos and modify the PUD conditions in exchange fo doing the tentative map. <br />Mr. Beougher replied that as he read the statutes, he saw no way th t could be done. It is <br />not a discretionary permission. The statute simply says an extensio can be granted. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Scott D. Shaull, 2001 Winword Way, San Mateo, represented West rook Housing Group. <br />As stated in their previous appearances, they have no objection to y of the conditions. <br /> <br />Mr. Shaull thought that the major items that were of concern in D <br />recreation facility, streets, concrete, and landscaping of retention b ins. The recreation <br />center has been completed and is being used by the association at th s point in time. There <br />are some other items that have not been taken care of yet, but the a plicant is attempting to <br />do so. He thought that staff was pleased with their progress at this int. <br /> <br /> <br />Chairman Hovingh referred to Condition 3 in regard to grading pe its and/or building <br />permits and that they shall not be issued until all improvements in T cts 5721 and 5825 are <br />~ completed. He questioned Mr. Shaull as to the status of this. <br /> <br />Larry Snyder, 1375 Bordeaux Street, represented the Kottinger Ran h Home Association as <br />president. He said back in December of 1991 they were concerned about Conditions 5 and <br />6. When the people in the neighborhood bought their homes they d d not know there would <br />be trails going into the hills; they were also concerned about the sta ing area, which they <br />perceived would be a parking area for drug users, four-wheeling, v dalism, etc. Since that <br />time the association has met with Mr. Swift and Mr. Rasmussen an has had further follow- <br />up discussions. It appears now that the staging area has been remo ed which they are happy <br />about. In regard to the trails, they are willing to work with the Ci on that and foresee no <br />problems at this point. <br /> <br />In response to Mr. Snyder's question, Mr. Swift replied that in this particular case 300 ft. is <br />all that is needed for a trail easement.
