It was also
noted that staff will discuss the matter of a less costly footbridge wi the applicant.

~

Chairman Hovingh stated he is somewhat concerned about the treatm nt of the cul-de-sac and
would like to see one lot eliminated. He further noted that if he thou ht the neighbors were
not going to subdivide their properties someday he would be more sy pathetic to their
concerns regarding construction on the cul-de-sac.

NEW BUSINESS - PUBLIC HEARINGS

AP-92-10/V-92-7. Michael D. Schibler
Appeal of a decision of the Zoning Admini~tor denying an app 'cation for a variance
from the Municipal Code to reduce the required fence setback fo a street side yard of
the residence located at 4298 Fairlands Drive. Zoning for the pr rty is R-I-6,500.

Mr. Swift presented the staff report recommending denial of Case A -92-101V-92-7.

Commissioner McGuirk asked Mr. Swift for clarification as to why a variance is necessary.
Mr. Swift said the Code was modified some years ago to make the se back 5 ft. from street
side of a property. That 5 ft. dimension starts, according to the Cod , a distance of 15 ft.
back from the point of the house closest to the front yard. The reaso is mostly for
aesthetics so that a fence will not run all the way up the front of the ouse and square off on
those kinds of streets,

.'_ Planning Commission Minutes
lone 10, 1992

Page 10
