Mr. Swift presented the staff report recommending approval of It s I and 2, but denying Item 3 for Case PUD-85-10-1M. Staffis recommending that the 'me restrictions be continued, Commissioner Mahem expressed concern that the area under disc ssion is well-defined and that a tenant cannot easily go and pick up extra parking spaces. S e further discussed with Mr. Swift the possibility of changing the parking regulations som time in the future if the need arises. Commissioner Horan asked for clarification of the problems expe enced by people living at Longspur Way and whether the problems originated from the Popi Lounge. Mr. Swift commented the lounge has created some problems from time to ti e; however, there is also a large landscaped area behind the lounge that has caused some pr blems. The area of La Petite Academy and the adjacent building was zoned as Public and Institutional. There was an agreement between the neighbors and the City that there would e no church institution at that site, but that the day care center and another service-type buil ing with parking restrictions was acceptable. Staff felt that restriction was legitimat some years ago and feels it should remain at this time. THE PUBLIC HEARING WAS OPENED. Laurinda Stout, 1814 Franklin Street, Oakland, represented Portfol 0 Property and the application. She stated she thought the complaints were very muc exaggerated, and that she personally has not heard any complaints during the last five years. he noted that the No- Sweat Toning Salon stays open until 9 p.m. and that locking that ea of the parking lot poses a potential danger to those women who would have to walk cross the parking lot to their cars. Hence, she requested that the area remain unlocked un 19 p.m, Elizabeth M. Stephens, 2793 Longspur Way, said she has lived the e since 1985 and since the addition of La Petite Academy. She stated she walks through at parking area five nights a week and it is never locked at 7:30 p.m. as it is supposed 0 be. She noted that the noise in summer is quite annoying from the Popi Lounge and from e landscaped area and parking lot. She sees no reason to change the hours of parking usa e. She agreed that Area 1 should remain open; however, she did not wish the hours of the ained area to be changed. She feels that the parking lot is very well-lit and that pa ns of the No-Sweat Salon would have no problem walking to the Area 1 parking lot. er objection included car noises from the parking lot. She also referred to a comme t by Ms. Stout that there was indeed a fire on the outside premises in the landscaped ar .
