<br />Mr. Swift presented the staff report recommending approval of Ite s 1 and 2, but denying <br />Item 3 for Case PUD-85-1 Q-IM. Staff is recommending that the ti e restrictions be <br />continued. <br /> <br />Commissioner Mahem expressed concern that the area under discus ion is well-defined and <br />that a tenant cannot easily go and pick up extra parking spaces. Sh further discussed with <br />Mr. Swift the possibility of changing the parking regulations some me in the future if the <br />need arises. <br /> <br /> <br />Commissioner Horan asked for clarification of the problems experi <br />Longspur Way and whether the problems originated from the Popi unge. Mr. Swift <br />commented the lounge has created some problems from time to tim ; however, there is also <br />a large landscaped area behind the lounge that has caused some pro lems. The area of La <br />Petite Academy and the adjacent building was zoned as Public and nstitutional. There was <br />an agreement between the neighbors and the City that there would e no church institution at <br />that site, but that the day care center and another service-type build ng with parking <br />restrictions was acceptable. Staff felt that restriction was legitimate some years ago and feels <br />it should remain at this time. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Laurinda Stout, 1814 Franklin Street, Oakland, represented Portfoli Property and the <br />application. She stated she thought the complaints were very much exaggerated, and that she <br />personally has not heard any complaints during the last five years. he noted that the No- <br />Sweat Toning Salon stays open until 9 p.m. and that locking that ar of the parking lot <br />poses a potential danger to those women who would have to walk a ross the parking lot to <br />their cars. Hence, she requested that the area remain unlocked unti 9 p.m. <br /> <br />Elizabeth M. Stephens, 2793 Longspur Way, said she has lived the e since 1985 and since <br />the addition of La Petite Academy. She stated she walks through at parking area five <br />nights a week and it is never locked at 7:30 p.m. as it is supposed 0 be. She noted that the <br />noise in summer is quite annoying from the Popi Lounge and from e landscaped area and <br />parking lot. She sees no reason to change the hours of parking usa e. She agreed that Area <br />1 should remain open; however, she did not wish the hours of the hained area to be <br />changed. She feels that the parking lot is very well-lit and that pa ns of the No-Sweat <br />Salon would have no problem walking to the Area 1 parking lot. er objection included car <br />noises from the parking lot. <br /> <br /> <br />Commissioners Horan and McGuirk discussed the noise issue with s, Stephens. <br /> <br />Lisa Pozzebon, 2808 Longspur Way, said she has reported disturb ces in the center to the <br />police rather than Portfolio Property. She also referred to a comm nt by Ms. Stout that <br />there was indeed a fire on the outside premises in the landscaped . She further noted <br />that part of the parking lot is considerably higher than others, m 'g it very easy for people <br />to jump the fence and get into her yard.
