the procedure hereinabovs set forth for obtaining new li consos. <br /> <br /> SECTION 10. Any party aggrieved by any decision or action <br />of the City Health Officer may appeal the same to the City Council <br />in writing and request a public hearing thereon by <br /> <br /> SECTION ll. In the event of such a~peal, the City Council <br />shall fix a time and place for a public hearing thereon within not <br />less than 5 nor more than 30 days, and shall give not less than <br />days notice thereof in writing to the person requesting such hearing <br />by mail, postage prepaid to the address shown in such request, and <br />shall also give notic~ thereof to the City Health Officer. At the <br />time fixed for sueh hearing or at any later time to which such hear- <br />ing may be adjourned, the City Council shall proceed to hear the <br />testimony of the appellant and of others in his behalf and of the <br />City Mealth Officer and othors in his behalf and of other competent <br />persons who may be present and desire to testify or who may be called <br />by the City Council to give testimony at such hearing. Upon the <br />conclusion of said hearing, said City Council shall by resolution de- <br />clare its findings an~ decision in the matter. The Council may either <br />overrule the Health Officer, modify his order, or uphold the same in <br />har~aony with the purpose of this Ordinance to preserve the public <br />health. The decision of the City Council rendered after a hearing <br />held in the manner prescribed herein, shall be final and conclusive. <br /> <br /> SECTION 12. The City Health Officer may do through his <br />duly'appointed agents and deputies, any act required or permitted of <br />him herein except that of presidin~ at the hearing and rendering the <br />decision referred to in Section 9 hereof. <br /> <br /> SECTION 13. No person shall deny to the City ~ealth Of- <br />ficer or his agents or deputies the right to enter or inspect at all <br />reasonable ~imes, any premises or vehicle within this City where it <br />is suspected that food is kept, handled or sold. <br /> <br /> SECTION l~. No person shall deny to the City Health Of- <br />ficer or his agents or deputies ~he right to purchase at market price <br />samples of any food, nor conceal from such Officer and his agents or <br /> <br /> - 3 - <br /> <br /> <br />
