ORDINANCE NO. <br /> <br /> AN ORDINANCE REGULATING <br /> TEE HANDLING AND SALE OF FOOD. <br /> <br />The Council of the Town of Pleasanton do ordain as follows: <br />SECTION l~ As used in this Ordinance the following words <br />shall be used in the sense in which they are now or hereafter defined <br />or applied in the following sections of the California Health and <br />Safety Code, respectively: <br /> <br /> "food" as in Section 26450, <br /> ~,contaminated- as in Section 26458, <br /> ~,sale-, -sell,, and "sold" as in Section 28459, <br /> "adulterated- as in Sections 26470, 264V1 and 28472. <br /> <br /> SECTION 2. No person shall handle, keep, sell or prepare <br />food except in clean and sanitary premises, and in a manner to pre- <br />vent such food from becoming unclean, insanitary, adulterated or con- <br />tami nated. <br /> <br /> SECTION 3. No person shall sell food, either cooked or <br />uncooked, without a license to do so issued as provided herein, in <br />addition to such license or licenses as may be required under the <br />provisions of Ordinance No. ll3 of the Town of Pleasanton as amended. <br /> <br /> SECTION 4. That City Officials of the Town of pleasanton <br />shall not issue any license for handling or selling food to any per- <br />sonsor any.premises which have not previously been licensed for such <br />purposes unless the applicant presents to him a certificate from the <br />City Health Officer stating that he has examined the premises in <br />which applicant intends to prepare and/or sell food and has found <br />them to be in a condition conforming to the provisions of this <br />Ordinance and which will tend to protect the food kept, handled or <br />sold therein from becoming unclean, insanitary, adulterated or con- <br />tami nat ed. <br /> <br /> SECTION 5. It shall be the duty of the City Health Officer, <br />upon application, to examine the premises in which any person in- <br />tends to keep, sell or handle food and to advise the applicant of <br />such conditions, if any, as he finds must be altered or improved to <br /> <br /> -1- <br /> <br /> <br />
