· All financial transactions would continue to be conducted through a Point of Sale (POS)
system operated by City staff, with cash and check receipts deposited daily.

· Lifetime Tennis plans to host a reception as soon as possible with tennis participants to
gather input on future tennis programming ideas and service improvements.

· Lifetime Tennis would maintain general liability, automobile liability and workers'
compensation insurance for its operations.

· All Lifetime Tennis employees would wear appropriate tennis uniforms to project a
professional image and be easily recognized by patrons.

· Hours of operation would be expanded under this new Agreement. The facility would
open at 8:00 am each day as opposed to 9:00 am, and close an hour later (10:00 pm) on
Saturday's.

As proposed, Lifetime Tennis would be paid 80% of all revenues collected from lessons,
leagues, and open play. Lifetime Tennis would also provide a knowledgeable staffperson in the
front office to answer tennis related questions and provide advice to customers during hours of
operation. Dana Gill, Executive Director of Lifetime Tennis, has committed to be on site at
least 25 hours per week during the first year, and a yet to be hired General Manager would be
available an additional 20 hours. This would help to provide consistent customer service to
those who use the facility.

Another element of Lifetime Tennis' proposal is to provide expanded pro shop services at the
tennis complex. This would include tennis racquets, grips, socks, tennis balls, and ready to
serve snacks. Tennis racquet stringing and grip repairs are new services that would now be
provided. The operator would pay $500 per month for the ability to provide these services.

During the "Meeting Open to the Public" portion of recent Council meetings, several tennis
players have expressed concern that a new operator would further limit court availability for
open play, and/or raise tennis fees. The City's current practice is to maintain two (2) courts
during regular hours for reservation and/or drop-in play, and Lifetime Tennis would continue
that philosophy. Four (4) additional courts would also be available for drop-in play during
weekday evenings and weekend mornings. Regarding the issue of fee changes, the operator is
obligated to submit an Annual Plan each year for review by the City. That plan would include
any suggestions for improvements to the facility, marketing/promotions activities, and
recommended price lists for service and/or fee increases. The Parks and Community Services
Department would review the proposed fees as part of its continual analysis of all fee based
classes and programs. Any fee increases in excess of 20% would require review and approval
by the Parks and Recreation Commission and City Council.

SR 05:097
Page 4
