<br />Resolution No. PC-93-58 <br />Page 3 <br /> <br />. <br /> <br />Although the retail store als would operate as a <br />consignment store for the sa e of used clothing, <br />customers leaving clothing n consignment would <br />patronize the store in a manner similar to <br />purchasing customers: clients would utilize nearby <br />on-street parking and make in ividual arrangements <br />wi th the store owner for res le of clothing and <br />purchase prices. Clothing i not "dropped off." <br />Therefore, the store would ppear as a typical <br />retail store and it would not e outwardly apparent <br />that the store accepted cl thing for sale on <br />consignment. The store's previous years of <br />consignment sale operations i the Downtown area <br />attest to its similarity to 0 her retail clothing <br />stores. The store would not subject surrounding <br />uses to heavy truck traffic, h zardous conditions, <br />or other objectionable influen es. <br /> <br />C. <br /> <br />That the proposed conditional <br />each of the applicable provisi <br /> <br /> <br />will comply with <br />of this chapter. <br /> <br />The site's Central Commercial oning conditionally <br />permits the establishment of stores which sell <br />secondhand clothing. In additi n, the proposed use <br />complies with all relevant sec ions of the zoning <br />ordinance. Granting a condit'onal use permit to <br />the applicants would be consist nt with the City's <br />ability to regulate zoning s listed in the <br />Municipal Code Chapter 18.124. <br /> <br />WHEREAS, projects of this nature are categoriclllY exempt from the <br />requirements of the California Envirormental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, <br /> <br />the Planning Commission determined <br />conditional use, as conditioned, is <br />site. <br /> <br />that the proposed <br />ppropriate for the <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-93-63, the applicat on of Rose Hinojos <br />(Best of Seconds) for a conditional us permit to operate <br />a secondhand clothing consignment s ore as part of a <br />retail store selling new clothing 1 cated at 234 Main <br />Street, subject to the conditions sh wn on Exhibit "B" <br />attached hereto and made part of this case by reference. <br /> <br />Section 2.
