PC-93-55 i <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PE~T AS FILED UNDER <br />CASE UP-93-49, THE APPLICATION OF DORIS C ALLO <br /> <br />WHEREAS, Doris Caraballo has applied for a con itional use permit <br />to establish a secondary unit within single-family home <br />at 4977 Forest Hill Drive; and I <br /> <br />WHEREAS, zoning for the property is Planned unitt Development (PUD) <br />_ Medium Density Residential Distric~; and <br />i <br /> <br />WHEREAS, at their duly noticed public heari g of September 22, <br />1993, the Planning Commission con idered all public <br />testimony, relevant exhibits and rec mmendations of the <br />City staff concerning this applicati n; and <br /> <br />WHEREAS, <br /> <br />the <br /> <br />planning commission made the fo lowing findings: <br /> <br />That the proposed location Offhe conditional use <br />is in accordance with the obje tives of the zoning <br />ordinance and the purpose of t e district in which <br />the site is located. <br />I <br />The request to establish a sec nd unit in the PUD- <br />MDR district conforms with he objectives and <br />purposes of the zoning ordin nce. The proposed <br />secondary unit would main ain the physical <br />single-family character of the neighborhood due to <br />its integration wi thin the p oposed home. When <br />viewed from the exterior, it w uld not be possible <br />to tell that the home conta' ns a second unit. <br />However, there is concern wit the maintenance of <br />the single-family lifestyle 0 the neighborhood. <br />Depending on whether the prop rty is sold in the <br />future, the buyer could rent one or both of the <br />dwelling units. This situatio could impart multi- <br />family characteristics on th neighborhood. In <br />order to prevent this situati n from happening, a <br />condition which requires that either the primary <br />residence or the secondary un t be owner-occupied <br />has been included. <br /> <br />A. <br /> <br />B.
