That the proposed location of he conditional use <br />and the conditions under which 't would be operated <br />or maintained will not be detri ental to the public <br />health, safety, or welfare, or terially injurious <br />to the properties or improvemen s in the vicinity. <br /> <br />The project, as proposed and co ditioned, requires <br />these uses to be operated in ann-nuisance manner. <br />Sufficient parking, traffic cap city and separation <br />from residential neighborhoods ave been provided. <br />The business is located in a building where <br />nighttime uses would not cre te a nuisance to <br />adjoining areas. Streets lead'ng to the site are <br />designed per City standards an are signalized to <br />provide safe access into and ou of the site. The <br />conditions of approval of th use permit will <br />ensure that the establishment remains within the <br />standards of all applicable cit codes. <br /> <br />C. That the proposed conditional u e will comply with <br />each of the applicable provis ons of the zoning <br />ordinance. <br /> <br />The site's PUD zoning conditi nally permits the <br />establishment of bars, as defin d by Municipal Code <br />section 18.08.028. The propose use complies with <br />all relevant sections of the zoning ordinance. <br />Granting a conditional use perm't to the applicants <br />for a bar is consistent with th city's ability to <br />regulate zoning as listed in he Municipal Code <br />Chapter 18.124 "Conditional Use ." <br /> <br />WHEREAS, projects of this nature are categoric lly exempt from the <br />requirements of the California Envir nmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />conditional use, as conditioned, wil be compatible with <br />the surrounding businesses and will not detrimentally <br />affect the surrounding uses or prope ties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-93-47, the applic tion of Barry Mori <br />and Eric Nostrand for a conditio al use permit to <br />establish an approximately 3,570 squa e foot bar/alehouse <br />and grill in the Hopyard Village Shop ing Center located <br />at 3015 Hopyard Road, Suites F, G, a d H, subject to the <br />conditions shown on Exhibit "B" atta ed hereto and made <br />part of this case by reference. <br />
