The applicant shall attempt to obtain the co plete abandonment <br />of the current access easement between "B" ourt and Foothill <br />Road prior to final map approval. Should t e applicant fail, <br />the City may use its powers of eminent doma'n to condemn this <br />portion of the access easement. The appli ant shall pay all <br />costs associated with eliminating this eas ment. <br /> <br />6. Prior to final map approval, that specific improvement plans <br />for the pond shall be submitted to the Depa tment of Fish and <br />Game and the Planning Director for review nd approval. <br /> <br />7. Prior to approval of any final map, the precise alignment plan <br />and easement specifications for the on-si e trails shall be <br />developed in coordination with the Parks an Community service <br />Director and the Planning Director. The actual alignment <br />shall be based on a field reconnaissance w th City staff and <br />the trails shall follow as much as possible existing informal <br />paths on the site to minimize grading requi ements. The trail <br />design and maintenance responsibilities s all be consistent <br />with city Council Resolution No. 92-104. <br /> <br />8. Prior to approval of the final map, developer shall <br />establish a Landscape and Lighting Mainte ance District for <br />the entire site and a landscape and lig ting maintenance/ <br />conservation easement over the open space a eas. The district <br />shall have sole and full responsibility fo the maintenance, <br />inspection, repair of the street lighting, pen space area and <br />fire management areas, landscaping within pUblic rights-of- <br />way, and habitat areas. The establishment and incorporation <br />of this district shall be subject to the r view and approval <br />of the City Attorney, City Engineer, and lanning Director. <br />
