The proposed location of the onditional use and <br />the conditions under which it ould be operated or <br />maintained will not be detrim ntal to the public <br />health, safety, or welfare, or aterially injurious <br />to the properties or improveme ts in the vicinity. <br /> <br />If the conditional use is p rmitted, the suite <br />would be properly retrofitted to accommodate the <br />needs of the applicant and h' s clientele and to <br />properly insulate the proposed linic from adjacent <br />commercial uses. The clinic ould not adversely <br />affect the availability of pa king spaces in the <br />shopping center complex. <br /> <br />3. The proposed conditional use w II comply with each <br />of the applicable provisions 0 this chapter. <br /> <br />The conditional use is require to comply with all <br />applicable sections of the Muni ipal Code governing <br />properties zoned Neighborhoo Commercial. By <br />complying with the recomme ded conditions of <br />approval, the application wou d meet the criteria <br />for receiving a conditional u e permit and would, <br />therefore, comply with the i tent of the zoning <br />Ordinance. As with any use pe it, the permit for <br />this veterinary clinic can be uspended or revoked <br />if the conditions are not met. <br /> <br />WHEREAS, projects of this nature are categori ally exempt from the <br />requirements of the California Envi onmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, <br /> <br />the Planning commission determine <br />conditional use, as conditioned, wi <br />the existing retail/service uses <br />Shopping Center. <br /> <br />that the proposed <br />1 be compatible with <br />in the Oak Hills <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF T E CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-93-38, the appli ation of Clifford A. <br />Zucco, D.V.M., for a conditional us permit to allow the <br />operation of a veterinary clinic in an 1,800 square foot <br />tenant space located at 5480 Sunol Boulevard in the Oak <br />Hills Shopping Center, subject to t e conditions shown on <br />Exhibit "B" attached hereto and mad part of this case by <br />reference. <br /> <br />Section 2. This resolution shall become ef ective 15 days after <br />its passage and adoption unless a pealed prior to that <br />time. <br />
