If the conditional use is p rmitted, the suite would be properly retrofitted to accommodate the needs of the applicant and h' s clientele and to properly insulate the proposed linic from adjacent commercial uses. The clinic ould not adversely affect the availability of pa king spaces in the shopping center complex. 3. The proposed conditional use w II comply with each of the applicable provisions 0 this chapter. The conditional use is require to comply with all applicable sections of the Muni ipal Code governing properties zoned Neighborhoo Commercial. By complying with the recomme ded conditions of approval, the application wou d meet the criteria for receiving a conditional u e permit and would, therefore, comply with the i tent of the zoning Ordinance. As with any use pe it, the permit for this veterinary clinic can be uspended or revoked if the conditions are not met. WHEREAS, projects of this nature are categori ally exempt from the requirements of the California Envi onmental Quality Act (CEQA); and WHEREAS, the Planning commission determine conditional use, as conditioned, wi the existing retail/service uses Shopping Center. that the proposed 1 be compatible with in the Oak Hills NOW, THEREFORE, THE PLANNING COMMISSION OF T E CITY OF PLEASANTON RESOLVES THE FOLLOWING: section 1. Approves Case UP-93-38, the appli ation of Clifford A. Zucco, D.V.M., for a conditional us permit to allow the operation of a veterinary clinic in an 1,800 square foot tenant space located at 5480 Sunol Boulevard in the Oak Hills Shopping Center, subject to t e conditions shown on Exhibit "B" attached hereto and mad part of this case by reference. Section 2. This resolution shall become ef ective 15 days after its passage and adoption unless a pealed prior to that time.
