The proposed development shall conform substantially to the <br />site plans, elevations, and related materials, Exhibit "A" <br />(dated "Received November 20, 1992"), on file with the <br />Planning Department, except as modified by these conditions. <br /> <br />2. The developer shall obtain all building and other applicable <br />city permits for the project prior to the commencement of <br />construction. <br /> <br />3. All conditions of approval of PUD-92-1 (Ordinance No. 1553) <br />shall remain in full force an effect, except as modified by <br />these conditions. <br /> <br />4. The Design Guidelines regulations for house height shall be <br />controlling, 24' limit for single-story houses and 30' limit <br />for two-story houses. <br /> <br />5. If construction of this subdivision proceeds before <br />construction of the subdivision covered by Tract 6505, the <br />developer of this subdivision shall, with the first <br />construction phase, construct stone pointe Way from Stoneridge <br />Drive to the site. In the event this right-of-way cannot be <br />acquired by the developer, the city may exercise, at the <br />developer's request, its power of eminent domain to acquire <br />said right-of-way, subject to all costs being borne by the <br />developer. This project developer will be reimbursed by the <br />developer of Tract 6505 for costs incurred in acquiring and/ <br />or constructing stone Pointe Way. <br /> <br />6. With recordation of the final map, the developer shall <br />contribute the project's pro-rata share of the noise analysis <br />for the stoneridge Drive Specific Plan area, of the Mohr- <br />Martin sewer extension, and of the East Amador Relief Sewer <br />extension. <br /> <br />7. The project improvements shall not be phased, nor multiple <br />final maps filed. All subdivision improvements shall be <br />completed and accepted by the City Council prior to occupancy <br />of the lots. <br /> <br />8. with the subdivision, a l' wide strip of land shall be <br />provided between the public street and the Hulett, Singleton, <br />and Gonsalves property lines as a separate lot.
