<br />Resolution No. PC-92-96 <br />Page 2 <br /> <br />outdoor storage yards are a common use along Old <br />Santa Rita Road. with conditions limiting the <br />duration of the use permit, and regulating the <br />applicant's vehicle parking and outdoor uses, the <br />use can be accommodated without adverse impacts on <br />the other uses in the general vicinity. The <br />applicant can also be required to mitigate future <br />nuisances as a result of the proposed use. <br /> <br />c. That the proposed conditional use will comply with <br />each of the provisions of the Zoning Ordinance. <br /> <br />Chapter 18.124 of the Municipal Code (Conditional <br />Uses) states that, because of their unusual <br />characteristics, conditional uses require special <br />consideration so that they may be located properly <br />with respect to their effects on surrounding <br />properties. Reasonable conditions of approval can <br />integrate the proposed use without detrimentally <br />affecting the surrounding properties or the city in <br />general. The proposed use will also comply with <br />all provisions and requirements of the city's <br />zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />conditional use is appropriate for the site. <br /> <br />NOW, THEREFORE, THE PLANNXNG COMMISSION 01' THE CITY 01' PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-92-49, the application of James E. <br />Butts for a conditional use permit to operate a landscape <br />contractor's equipment storage yard and office at 3768 <br />Old santa Rita Road , subject to the conditions shown on <br />Exhibit "B" attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br /> <br />" <br /> <br />. I <br />
