<br />PLANNING COMKISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-96 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USB PERMIT AS PILED UNDER <br />CASE UP-92-49 FOR JAKES E. BUTTS <br /> <br />WHEREAS, James E. Butts has applied for a conditional use permit <br />to operate a landscape contractor's equipment storage <br />yard and office at 3768 Old Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is C-s (Service commercial) <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of November 30, <br />1992, the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />city staff concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Some of the objectives of the zoning ordinance are <br />to: foster a harmonious, convenient, workable <br />relationship among land uses, protect existing land <br />uses from inharmonious influences and harmful <br />intrusions, and to insure that public and private <br />lands ultimately are used for the purposes which <br />are most appropriate and beneficial to the city as <br />a whole. As conditioned, the proposed use would be <br />consistent with these objectives. <br /> <br />The subject site is located within a service <br />commercial zoning district. The purpose of the <br />service commercial district is to provide locations <br />for uses that normally require relatively large <br />sites with off-street parking, attract little or no <br />pedestrian traffic, and have features that are <br />incompatible with other commercial districts. The <br />proposed use is in keeping with purposes of the C-S <br />District and, therefore, this finding can be made. <br /> <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />11 <br /> <br />. <br />
