Thus, <br />the six-foot height limit combined with the 80 <br />sq. ft. maximum size, adversely impacts the property <br />owners. <br /> <br />2. That the granting of the variance will not <br />constitute a grant of special privilege <br />inconsistent with the limitation of other <br />properties classified in the same zoning district. <br /> <br />By requiring the tool shed to be relocated on the <br />subject property and screened with any necessary <br />landscaping (to ensure that the shed is not <br />visible), project approval is consistent with the <br />limitations on other properties in the development. <br /> <br />3. That the granting of the variance will not be <br />detrimental to the public health, safety or <br />welfare, or materially injurious to properties or <br />improvements in the vicinity. <br /> <br />The subject approval has been conditioned to meet <br />all applicable code requirements to ensure that all <br />health and safety issues are addressed. <br />Additionally, the required screening, if needed, <br />will ensure that all aesthetics issues have been <br />addressed. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case AP-92-17, the application of Catherine <br />Rainey, the appeal a condition of approval of Case <br />V-92-13 which required that the existing 8 foot high <br />storage shed located at 4153 Moller Drive be relocated on <br />the subject property, subject to the following <br />conditions: <br /> <br />1. The relocation and any required landscape screening <br />or the shed's removal shall be accomplished within <br />ninety (90) days from the effective date of <br />approval. <br />
