PC-92-94 <br /> <br />RESOLUTION APPROVING CASE AP-92-17 (THE APPEAL OF A CONDITION <br />OF APPROVAL OF CASE V-92-13) THE APPLICATION OF CATHERINE <br />RAINEY <br /> <br />WHEREAS, on september 14, 1992, the Zoning Administrator granted <br />approval of a variance from the Municipal Code to allow <br />the retention of an existing storage shed located at 4153 <br />Moller Drive, which exceeds the allowed height limit for <br />Danbury Park; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Medium Density Residential District; and <br /> <br />WHEREAS, within the time specified by the P1easanton Municipal <br />Code, Catherine Rainey appealed a condition of approval <br />of Case V-92-13 which required that the existing 8 foot <br />high storage shed be relocated on the subject property; <br />and <br /> <br />WHEREAS, at its duly noticed public hearing of November 11, 1992, <br />the Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />1. That because of special circumstances applicable to <br />the property, including size, shape, topography, <br />location or surroundings, the strict application of <br />the provisions of the zoning regulation deprives <br />such property of privileges enjoyed by other <br />properties in the vicinity and under identical <br />zoning classification. <br /> <br />The subj ect lot is considerably larger <br />(6,500 sq.ft.) than the average lot size within the <br />overall development. Thus, the property is more <br />directly comparable to other properties that are <br />located within a R-1-6500 zoning district. within <br />the R-1-6500 zoning district, properties are not <br />subject to the six-foot maximum height limit that <br />governs the subject property. Because of this, the <br />subject property is negatively impacted by the six- <br />foot height limit within the development which was <br />developed to ensure that sheds located on smaller <br />lots are not visible from off-site. Additionally, <br />because of the size of the property, the owners may <br />need to have a greater amount of outdoor <br />
