<br />Land Use <br /> <br />32. Create two zones for Downtown, as follows: <br /> <br />Zone 1: <br /> <br />pedestrian Retail. Main street from the Arroyo to <br />Bernal Avenue. <br /> <br />Retail on the ground floor, except for businesses which do <br />not have direct frontage on Main street. <br /> <br />'.:.:-.... <br />-:;;;~~ <br /> <br />When a pre-existing non-conforming use vacates a ground <br />floor tenant space, the property owner has 90 days to rent <br />to a permitted (retail) use. If unsuccessful, a non-retail <br />use permitted in Zone 2 is allowed. <br /> <br />~ <br /> <br />A building which was specifically designed to accommodate <br />office or professional uses and which does not, without <br />extensive exterior and interior alteration, lend itself to: <br />retail uses, will remain unaffected by the "retail-only" <br />restriction as a non-conforming use so long as any portion- <br />of the building is occupied by those uses. <br /> <br />~. <br /> <br />The "retail-only" provision will be reviewed every two years <br />to determine its impact on Downtown property owners and tha <br />Downtown in general. <br /> <br />The definition of "retail" is expanded to include personal <br />services, theaters, commercial nurseries, and mail box <br />services. <br /> <br />Financial institutions, churches, and second hand stores are <br />conditional uses in Zone 1. <br /> <br />The current financial institution policy is repealed. <br /> <br />The following uses are not permitted on the ground floor in <br />Zone 1, except as provided above: offices, professional <br />services, clubs, trade schools, real estate offices, tax <br />return preparation services. <br /> <br />The following uses are not permitted anywhere in Zone 1: <br />car dealers, service stations, automobile repair, drive-in <br />or take-out restaurants, and print shops. <br /> <br />Second floor uses include but are not limited to offices, <br />professional services, and residential. <br /> <br />., <br /> <br />4 <br /> <br />II <br /> <br />.
