PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-92-82

RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER
CASE UP-92-46 FOR ROBERT W. BYRD

WHEREAS, Robert W. Byrd has applied for a conditional use permit
to construct a second unit over a garage of a proposed
single-family home located at 4186 Remillard Court; and

WHEREAS, zoning for the property is PUD (Planned Unit Development)
- Low Density Residential, Medium Density Residential,
and Open Space District; and

WHEREAS, at their duly noticed public hearing of September 23,
1992, the Planning commission considered all public
testimony, relevant exhibits and recommendations of the
city staff concerning this application; and

WHEREAS, the Planning Commission made the following findings:

A. The proposed location of the conditional use is in
accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

The request to establish a second unit in the PUD-
LDR/MDR/OS district conforms with the objectives of
the zoning ordinance. The proposed second unit
would maintain the physical single-family character
of the neighborhood due to its integration within
the proposed home. When viewed from the exterior,
it would not be possible to tell that the home
contains a second unit. In order to prevent multi-
family characteristics from originating within the
neighborhood, staff has recommended a condition of
approval which requires that either the primary
residence or the second unit be owner-occupied. It
is important to limit the occupancy of the
secondary unit to two adult occupants (plus any
children) to maintain a low density and traffic
volume for the neighborhood.

B. The proposed location of the conditional use and
the conditions under which it would be operated or
maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to the properties or improvements in the vicinity.

The following issues should be considered within
the scope of the public health, safety and welfare:

II
