<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-82 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-92-46 FOR ROBERT W. BYRD <br /> <br />WHEREAS, Robert W. Byrd has applied for a conditional use permit <br />to construct a second unit over a garage of a proposed <br />single-family home located at 4186 Remillard Court; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Low Density Residential, Medium Density Residential, <br />and Open Space District; and <br /> <br />WHEREAS, at their duly noticed public hearing of September 23, <br />1992, the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a second unit in the PUD- <br />LDR/MDR/OS district conforms with the objectives of <br />the zoning ordinance. The proposed second unit <br />would maintain the physical single-family character <br />of the neighborhood due to its integration within <br />the proposed home. When viewed from the exterior, <br />it would not be possible to tell that the home <br />contains a second unit. In order to prevent multi- <br />family characteristics from originating within the <br />neighborhood, staff has recommended a condition of <br />approval which requires that either the primary <br />residence or the second unit be owner-occupied. It <br />is important to limit the occupancy of the <br />secondary unit to two adult occupants (plus any <br />children) to maintain a low density and traffic <br />volume for the neighborhood. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The following issues should be considered within <br />the scope of the public health, safety and welfare: <br />
