<br />La Familia will serve alcoholic beverages in its <br />10unge as an adjunct to its operation as a full- <br />service restaurant. No dancing or live music wi11 <br />be provided. A complete appetizer and dinner menu <br />will be available to the lounge patrons. Thus, La <br />Familia would still be operated in a manner making <br />it compatible with the other retail/service <br />businesses in the shopping center and the <br />residential uses. <br /> <br />c. The proposed conditional use will comply with each <br />of the applicable provisions of the Municipal Code <br />which apply to Conditional Uses. <br /> <br />By complying with the recommended conditions of <br />approval, the application would meet the criteria <br />for receiving a conditional use permit and would, <br />therefore, comply with the intent of the Zoning <br />Ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the california Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the planning commission determined that the proposed <br />conditional use will be compatible with the <br />retail/service uses in the Santa Rita square commercial <br />center and the residential properties adjoining the <br />center. <br /> <br />NOW, THEREFORE, THE pLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-92-42, the application of Cardoza <br />properties for a conditional use permit to allow a <br />restaurant serving alcoholic beverages after 10:00 p.m. <br />(La Familia Mexican Restaurant) located at 3180 Santa <br />Rita Road, subject to the conditions shown on Exhibit "A" <br />attached hereto and made part of this case by reference. <br /> <br />Section 2.
