<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-73 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-92-42 FOR CARDOZA PROPERTIES <br /> <br />WHEREAS, Cardoza Properties has applied for a conditional use <br />permit to allow a restaurant serving alcoholic beverages <br />after 10:00 p.m. (La Familia Mexican Restaurant) located <br />at 3180 Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- C (Commercial) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of August 26, 1992, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />One of the main purposes of the zoning ordinance is <br />to foster a harmonious, workable relationship <br />between land uses. The PUD zoning district in <br />which La Familia restaurant is located is <br />conditioned to prohibit night time businesses in <br />order to protect the single-family residential <br />properties adjoining the Santa Rita Square from <br />noise, loitering, etc. The Santa Rita Square <br />shopping center is constructed in a manner that <br />separates La Familia from said residential <br />properties by a 200' distance. In this area is <br />located parking, one of the main tenant buildings <br />of the shopping center, and a masonry wall located <br />on the common shopping center/residential property <br />line. Construction of the Santa Rita Square <br />shopping center provides adequate separation and <br />protection between La Familia and residential uses <br />adjoining the shopping center. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />
