<br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed dance club will be contained com- <br />pletely within the retail portion of the PUD site. <br />Sufficient parking, ample traffic capacity, clear <br />separation from the residential neighborhoods, <br />maintenance of noise levels, safety and security <br />within the premises have been provided. The <br />subject use will not create a nuisance during the <br />evenings, as staff has ensured that the use operate <br />under very specific conditions. All streets around <br />the site are designed per City standards to provide <br />safe ingress and egress, into and out of, the site. <br />The conditions of approval, as well as the <br />applicant manner of use of this proposal, will <br />ensure that the establishment shall remain within <br />the standards of all applicable city codes. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of the Municipal Code <br />which apply to Conditional Uses. <br /> <br />The site's PUD zoning permits the establishment of <br />dance studios, as outlined in the Municipal Code <br />Section 18.44.090. The granting of a use permit to <br />Dennis Leroy Thomson to operate a dance studio that <br />serves no alcohol is consistent with the city's <br />ability to regulate zoning as listed in the <br />Municipal Code section 18.124 "Conditional Uses." <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />conditional use is appropriate for the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-92-33, the application of Dennis Leroy <br />Thomson for a conditional use permit to establish a <br />country western dance facility within the existing <br />vintage Hills Shopping Center, subject to the conditions <br />shown on Exhibit "A" attached hereto and made part of <br />this case by reference. <br /> <br />Section 2. This resolution shall become effective l5 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
