PC-92-68 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-92-33 FOR DENNIS LEROY THOMSON <br /> <br />WHEREAS, Dennis Leroy Thomson has applied for a conditional use <br />permit to establish a country western dance facility <br />within the existing Vintage Hills Shopping center; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- C-N (Neighborhood Commercial) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of August 12, 1992, <br />the Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />One of the main objectives of the zoning ordinance <br />for any Neighborhood Commercial district is to <br />provide appropriately located areas for retail <br />stores, service establishments, amusement <br />establishments, and wholesale businesses, offering <br />commodities and services required by the residents <br />of the City and its surrounding market area. <br /> <br />The site of the proposed use is located within a <br />PUD-C-N district. Dance studios are conditionally <br />permitted in C-N districts as they provide a <br />service to the residents of Pleasanton in the form <br />of amusement and entertainment centers. The <br />proposed conditions of approval for the project <br />give the City the appropriate controls to ensure <br />that the use does not have adverse impacts on the <br />surrounding properties. The use permit for the <br />proposed dance studio is, therefore, in accordance <br />with the objectives of the zoning district. In <br />that the shopping center has been struggling, this <br />use may help draw more customers here making the <br />rest of the retail uses successful, and the center <br />more lively. <br /> <br />" <br />
