The applicant <br />can also be required to mitigate potential <br />nuisances which may arise in future. The subject <br />use provides for a beneficial and interesting <br />educational service to the community. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The subject travel school will not have an adverse <br />impact on surrounding properties or tenants due to <br />its small scale of use, method of operation, <br />performance standards, and the included conditions <br />of approval. Also, parking is seen to be adequate. <br />The existing use will not subject surrounding uses <br />to heavy truck traffic, hazardous odors, or any <br />other objectionable influences. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of the Municipal Code <br />which apply to Conditional Uses. <br /> <br />As conditioned, the proposed use will comply with <br />all provisions and requirements of the City's <br />zoning ordinance. Granting a conditional use <br />permit to Western College of Travel Careers is <br />consistent with the city's ability to regulate <br />zoning as listed in the Municipal Code Chapter <br />18.44. and 18.124. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />conditional use is appropriate for this site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section L Approves Case UP-92-28, the application of Western <br />College of Travel Careers, Inc. for a conditional use <br />permit to operate a travel school to be located within <br />the EFC building located at 5700 stoneridge Mall Road, <br />suite 370, subject to the conditions shown on Exhibit "A" <br />attached hereto and made part of this case by reference. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
