EXHIBIT B <br /> CONDITIONS OF APPROVAL <br /> <br /> PUD-98-16-3M, David Bogstad and Jeff Woods <br /> Mariposa Ranch Development by Callippe Preserve Golf Course <br /> April 5, 2005 <br /> <br />1. The final design guidelines for the homes to be located on the lots of Mariposa <br /> Ranch shall substantially conform to the design guidelines, Exhibit A, Volume <br /> One, "Mariposa Ranch at Callippe Preserve," and Volume Two, "Mariposa Ranch <br /> at Callippe Preserve," dated "Received February 25, 2005" on file with the <br /> Planning Department, except as modified by the following conditions. <br /> <br />2. All conditions of Cases PUD-98-16, PUD-98-16-1M, and PUD-98-16-2M shall <br /> remain in full force and effect except as otherwise modified by this approval. <br /> <br />3. This approval including design guidelines and review procedures shall remain <br /> effective for the life of the development called Mariposa Ranch or by any future <br /> name unless modified by a subsequent City action. <br /> <br />4. The project developer shall provide all buyers of the lots in Mariposa Ranch with <br /> copies of the approved design guidelines and the project conditions of approval. <br /> <br />5. The following statements shall be added to the proposed design guidelines: <br /> <br /> a. The sides of the structures facing the golf course fairways shall be designed <br /> to address safety issues that might arise from the proximity of the golf <br /> course, e.g., using tempered glass in the windows that may be hit by golf <br /> balls. <br /> <br /> b. Roof-mounted photovoltaic systems shall be physically and visually <br /> integrated with the structure's roof materials and design, e.g., surface <br /> mounted, low profile, etc. <br /> <br /> c. Tree planting for the golf course homes shall be one tree per 750 square <br /> feet of lot area. Tree planting shall focus on using valley oak and live oak <br /> species. <br /> <br /> d. Safety nets to protect the houses from the proximity of the golf course shall <br /> not be allowed on any portion of the Mariposa Ranch lots. <br /> <br /> <br />
