Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />On January 4, 2005, the City Council reviewed the Bernal Property Phase II Specific Plan <br />and Phase I Sports Fields project as prepared by the firm of MD Fotheringham Landscape <br />Architects. The Council approved the schematic design for Phase I, and directed staff to <br />negotiate an agreement with the consultant to begin the work of construction document <br />preparation. <br /> <br />The proposed Scope of Work is very complete, and outlines an ambitious process of design <br />development that will culminate in contract documents suitable for competitive bidding. In <br />addition, the consultant will be responsible for construction observation and administration at <br />key points during the project's construction, tentatively scheduled to begin in spring, 2006. <br />Staff believes that the terms and conditions of the contract are fair and equitable. A copy of <br />the Contract for Consultant Services, including a list of subconsultants, is included as <br />Attachment 1 for the Council's review. In addition, a breakdown of the respective fees for <br />MD Fotheringham and the project subconsultants is provided as Attachment 2. <br /> <br />BUDGET and FISCAL IMPACTS <br /> <br />The Bernal Community Park Reserve for Phase I improvements (CIP #007065) has a current <br />fund balance of $4.77 million, which includes $291,000 in Proposition 40 State Park Bond Act <br />funds that were allocated after the original CIP budget was adopted. Based upon the <br />preliminary cost opinion for the Phase I improvements prepared by MD Fotheringham, this <br />amount should be sufficient to fund all of the proposed park amenities, provide an adequate <br />construction contingency, and cover the total estimated design and construction observation <br />fees. The exact project construction cost will not be known until the formal bid process is <br />concluded. The contract with MD Fotheringham Landscape Architects is for a not to exceed <br />total of $467,650, including reimbursable expenses. <br /> <br />Respectfully Submitted, <br /> <br />Jal~te~ W.
