<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-93-30 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE Up-g)-OS, THE APPLICATION OF ELAINE WILSON <br /> <br />WHEREAS, Elaine Wilson has applied for a conditional use permit to <br />establish a warehouse space for a San Francisco Chronicle <br />newspaper distributor within a portion of the existing <br />industrial building located within the Stanley Business <br />Park at 39 California Avenue, suite #307; and <br /> <br />WHEREAS, zoning for the property is Planned Unit Development (PUD) <br />- C (Commercial) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of May 26, 1993, the <br />Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Some of the objectives of the zoning ordinance are <br />to: foster a harmonious, convenient, workable <br />relationship among land uses, protect existing land <br />uses from inharmonious influences and harmful <br />intrusions, and insure that public and private <br />lands are used for the purposes which are most <br />appropriate and beneficial to the city. The <br />proposal would be consistent with these objectives. <br /> <br />The subject building is located in a commercial <br />area along California Avenue which has <br />characteristics of the City's Commercial Service <br />(C-S) zoning district. One purpose of the C-S <br />district is to provide locations for uses that can <br />operate in close proximity to commercial uses with <br />minimum adverse impacts. As proposed, the proposal <br />will not alter the exterior of the building. Due <br />to the off-peak characteristics and low intensity <br />of the proposed use, the proposal will not <br />interfere with the existing uses. As conditioned, <br />the proposed use will be compatible with adjacent <br />commercial uses. The applicant will also be <br />required to mitigate any future nuisances which may <br />occur as a result of the proposed use. <br />
