<br />(b) Reduction of Capaci~v. The Capacity shall <br />be reduced by City only by the amount of Treatment Capacity <br />which: <br /> <br />(1) is allocated to Developer by City for <br />use by Developer on the Property; and <br /> <br />(2) is both assigned by Developer to an <br />Assignee pursuant to an Assignment of Capacity and is allocated <br />I <br />to such Assignee by CitYi (in accordance with Article 3 of this <br />Exhibit B) for use by Assignees on the Property. <br /> <br />(c) Reevaluation. City shall monitor the <br />Capacity throughout the term of the Amendment as follows: <br /> <br />(1) boefficients Chanqe. Should the <br />applicable Coefficients be revised or modified in a manner that <br />results in the need for ~ore Capacity than that already <br />, <br />reserved by the City (pursuant to the Amendment and this <br />Exhibit B), then the City shall immediately reserve such <br />additional Treatment Cap~city as is necessary to allow the <br />buildout of the Property, under such revised or modified <br />Coefficients (the "Increased Remaining Capacity"). The <br />Coefficients under which' the original Capacity was determined <br />are those that were in place at the time the Amendment was <br />adopted by the City. <br /> <br />(2) ~5% Use.
