That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the <br />vicinity. <br /> <br />Given that the proposed hours of operation and the <br />manner in which the store would be operated are <br />similar to that of the adjoining businesses, the <br />subject proposal will not interfere with the <br />surrounding uses or disturb the surrounding <br />residential developments. The proposed use will <br />comply with applicable Building and Fire Codes. <br />Sufficient parking is available and staff sees no <br />potential for noise problems. The project will not <br />be detrimental to the public health, safety, or <br />welfare. <br /> <br />C. That the proposed conditional use will comply with <br />each of the provisions of the zoning Ordinance. <br /> <br />As conditioned, the proposed use will <br />all provisions and requirements of <br />zoning ordinance. <br /> <br />comply with <br />the city's <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />conditional use is appropriate for the site. <br /> <br />NOW, THEREFORE, THE PLANNXNG COMKXSSXON OF THE CXTY OF PLEASANTON <br />RESOLVES THE FOLLOWXNG: <br /> <br />Section 1. Approves Case UP-92-72, the application of Mike and <br />Kim Poon for a conditional use permit to operate a retail <br />aquarium store including sales and service at the <br />oakhills Shopping Center located at 5424 Sunol Boulevard, <br />subject to the conditions shown on Exhibit "B" attached <br />hereto and made part of this case by reference. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
