PC-93-01 <br /> <br />RESOLUTXON APPROVXNG A CONDXTXONAL USB PBRKXT AS FXLBD UNDER <br />CASB UP-92-72 FOR KXKE AND KXK POON (FJ:SBBB BXZNEZ) <br /> <br />WHEREAS, Mike and Kim poon has applied for a conditional use <br />permit to operate a a retail aquarium store including <br />sales and service at the Oakhills Shopping Center located <br />at 5424 Sunol Boulevard; and <br /> <br />WHEREAS, zoning for the property is C-N (Neighborhood Commercial) <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of January 13, 1993, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Some of the objectives of the zoning ordinance are <br />to: foster a harmonious, convenient, workable <br />relationship among land uses, protect existing land <br />uses from incongruous influences and harmful <br />intrusions, and to ensure that public and private <br />lands are used for the purposes which are most <br />appropriate and beneficial to the city as a whole. <br /> <br />The subject proposal is located in a commercial <br />area along SunolBoulevard which has <br />characteristics of the city's C-N (Neighborhood <br />commercial) zoning district. One purpose of the C- <br />N district is to locate appropriate areas for <br />retail stores and personalized service <br />establishments, patronized primarily by residents <br />with minimal adverse impacts on residential uses. <br />Due to similar operational characteristics, the <br />proposed use will be compatible with surrounding <br />businesses. Furthermore, the aquarium business <br />will provide a retail service currently not found <br />in the center, which will benefit residents of the <br />area. Finally, the business will not create noise <br />or traffic impacts which will intrude on the <br />surrounding neighborhood. Therefore, the proposal <br />would be consistent with these objectives. <br /> <br />.. <br /> <br />. <br /> <br />, . <br />
