PC-92-46 <br /> <br />RESOLUTION RECOMMENDING APPROVAL TO DELETE A REQUIREMENT <br />REGARDING THE LIMITATION OF THE FLOOR AREA UTILIZED BY HIGH <br />PARKING DEMAND TENANTS AND RECOMMENDING DENIAL TO DELETE A <br />REQUIREMENT REGARDING LIMITATION OF HOURS AND GATING FOR A <br />PARKING AREA AS FILED UNDER CASE PUD-S5-10-1M, THE APPLICATION <br />OF PORTFOLIO PROPERTIES <br /> <br />WHEREAS, Portfolio Properties has applied for approval of a major <br />modification to an approved Planned Unit Development to <br />delete two requirements: 1) limiting the floor area <br />utilized by high parking demand tenants to no more than <br />21,335 sq. ft.; and 2) limiting the hours of use and <br />requiring gating for a portion of the parking area at <br />Hopyard Village Center, an existing shopping center <br />located at 3003-3059 Hopyard Road and 5725-5737 Valley <br />Avenue; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Commercial; and <br /> <br />WHEREAS, <br /> <br />at their duly noticed hearing of May 27, <br />Planning Commission considered all public <br />relevant exhibits and recommendations of the <br />concerning this application; and <br /> <br />1992, the <br />testimony, <br />City staff <br /> <br />WHEREAS, minor modifications to land use limitations are <br />categorically exempt (Class 5) from the requirements of <br />the California Environmental Quality Act (CEQA) ; <br />therefore, no environmental document was prepared for <br />this report; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The plan is in the best interests of the public <br />health, safety, and general welfare: <br /> <br />The proposed elimination of the 21,335 sq. ft. cap <br />on high parking demand uses should not have an <br />adverse effect on either the plaza tenants, <br />surrounding property owners, or the general public <br />based on the parking analysis submitted with the <br />application. It is recommended that Condition 10, <br />which prohibits use of the La Petite Academy <br />parking area after 7:30 pm and before 6:30 am be <br />retained inasmuch as it appears to perform an <br />important function in achieving an appropriate <br />interface between the commercial and residential <br />uses. <br /> <br />.. <br /> <br />- <br />
