<br />completely indoors and in an office-like setting. <br />It will operate in such a way as to create minimal <br />impacts to surrounding uses. The applicant can <br />also be required to mitigate potential nuisances <br />which may arise as a result of the proposed use. <br />staff also believes that the proposed use will <br />provide a beneficial educational service to <br />children of the community. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed business will not have an adverse <br />impact on surrounding properties or tenants due to <br />its small scale of use, method of operation, and <br />performance standards included as conditions of <br />approval. Also, adequate parking has been provided <br />for the proposed use to meet the project demand. <br />The proposed use will not SUbject surrounding uses <br />to heavy truck traffic, hazardous odors, or other <br />objectionable influences. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of the Municipal Code <br />which apply to Conditional Uses. <br /> <br />As conditioned, the proposed use will comply with <br />all provisions and requirements of the City's <br />zoning ordinance. Granting a conditional use <br />permit to Huntington Learning Center is consistent <br />with the City's ability to regulate zoning as <br />listed in the Municipal Code Chapter 18.44. and <br />18.124. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, the Planning Commission determined that the proposed <br />conditional use is appropriate for this site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-92-14, the application of Aleta <br />Dent/Huntington Learning Center for a conditional use <br />permit to operate an educational tutoring center to be <br />located at 5820 Stoneridge Mall Road, suite 120, in the <br />Foothill Professional Center, subject to the conditions <br />shown on Exhibit "A" attached hereto and made part of <br />this case by reference. <br />
