<br />The project, as conditioned, requires the use to be <br />operated in a non-nuisance manner. A parking study <br />indicates the use would not have an adverse impact <br />on parking availability on-site or off-site. <br />Entrance-ways to, and exit-ways from, the site are <br />sufficient to permit the free flow of vehicles <br />without interference or congestion. As <br />conditioned, the location for loading and unloading <br />furniture will not be a nuisance to adjacent <br />properties or pose a hazard to other vehicles. <br /> <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter. <br /> <br />As proposed and conditioned, the use complies with <br />all applicable regulations of the PUD zone in which <br />it is located. Although the site of the proposed <br />use does not have enough parking spaces for the use <br />as determined by the City's Municipal Code, the <br />approved PUD stipulates that the Planning <br />Commission shall have the option to determine <br />required parking for bulk wholesale and retail uses <br />on a case-by-case basis. Based upon the parking <br />demand study prepared as part of the use permit <br />application, staff finds that the 25 on-site <br />parking spaces would be sufficient for the bulk <br />furniture store proposed. The immediately adjacent <br />on-street parking spaces can be utilized for <br />overflow parking. A condition of approval <br />regarding a review of the use if the use becomes a <br />nuisance due to noise, parking demand, etc. has <br />been added. <br /> <br />WHEREAS, a draft Negative Declaration was prepared in August 1991 <br />for the General Plan Amendment and PUD rezoning which was <br />approved for this site in January 1992. The proposed use <br />was contemplated under this Negative Declaration, <br />therefore, no additional environmental review is needed; <br />and <br /> <br />WHEREAS, the Planning Commission determined that the proposed <br />conditional use is appropriate for this site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-92-9, the application of Osicki <br />Partnership/Sherman Properties for a conditional use <br />permit to allow the establishment of a bulk furniture <br />retail store in an existing 19,000 square foot building <br />located at 7116 Johnson Drive, subject to the conditions <br />shown on Exhibit "A" attached hereto and made part of <br />this case by reference. <br />
