PLANNING COMMISSION CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-92-31

RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER
CASE UP-92-9 FOR OSICKI PARTNERSHIP/SHERMAN PROPERTIES

WHEREAS, Osicki Partnership/Sherman Properties has applied for a
conditional use permit to allow the establishment of a
bulk furniture retail store in an existing 19,000 sq. ft.
building located at 7116 Johnson Drive; and

WHEREAS, zoning for the property is PUD (Planned Unit Development)
- Business Park District; and

WHEREAS, at their duly noticed public hearing of March 25, 1992,
the Planning Commission considered all public testimony,
relevant exhibits and recommendations of the City staff
concerning this application; and

WHEREAS, the Planning Commission made the following findings:

A. That the proposed location of the conditional use
is in accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

The city has given this site a General Plan Land
Use designation of Business Park, and implemented
the General Plan designation by assigning a PUD-
Business Park zoning to the site. In addition to
general industrial-type uses, the PUD zoning also
conditionally permits bulk retail and wholesale
establishments. The proposed bulk furniture use is
in accordance with the conditionally permitted uses
of the PUD zoning. An objective of this particular
PUD zoning for the site was to provide an area in
which general industrial uses may establish opera-
tions, as well as permit limited bulk retail and
wholesale establishments. It was found that such
limited commercial uses would be appropriate since
they need the type of warehouse space existing in
this industrially-zoned area, in addition to the
freeway visibility and easy access which the site
possesses. The establishment of a bulk furniture
store on this site meets these objectives.

B. That the proposed location of the conditional use
and the conditions under which it would be operated
or maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to the properties or improvements in the vicinity.
