<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-31 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-92-9 FOR OSICKI PARTNERSHIP/SHERMAN PROPERTIES <br /> <br />WHEREAS, Osicki Partnership/Sherman Properties has applied for a <br />conditional use permit to allow the establishment of a <br />bulk furniture retail store in an existing 19,000 sq. ft. <br />building located at 7116 Johnson Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Business Park District; and <br /> <br />WHEREAS, at their duly noticed public hearing of March 25, 1992, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The city has given this site a General Plan Land <br />Use designation of Business Park, and implemented <br />the General Plan designation by assigning a PUD- <br />Business Park zoning to the site. In addition to <br />general industrial-type uses, the PUD zoning also <br />conditionally permits bulk retail and wholesale <br />establishments. The proposed bulk furniture use is <br />in accordance with the conditionally permitted uses <br />of the PUD zoning. An objective of this particular <br />PUD zoning for the site was to provide an area in <br />which general industrial uses may establish opera- <br />tions, as well as permit limited bulk retail and <br />wholesale establishments. It was found that such <br />limited commercial uses would be appropriate since <br />they need the type of warehouse space existing in <br />this industrially-zoned area, in addition to the <br />freeway visibility and easy access which the site <br />possesses. The establishment of a bulk furniture <br />store on this site meets these objectives. <br /> <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />
