<br />11. The applicant is responsible for Rose Avenue improvements <br />including widening the street to a minimum width of 28' to the <br />project site, constructing the full future Rose Avenue street <br />width along the site's frontage, including but not limited to <br />installing curb/gutter/sidewalk along the north side of the <br />street. The developer shall negotiate in good faith with the <br />property owners on Rose Avenue to acquire the additional <br />right-of-way needed to construct the 28 foot street, and <br />additional easements as required for the placement of <br />utilities northerly of the face of curb as determined by the <br />City Engineer. Said right-of-way shall extend from easterly <br />project limits to Rose Lane. Should the developer be unable <br />to acquire said right-of-way and easements, the city may use <br />its power of eminent domain. The developer shall reimburse <br />the City for any cost incurred in the right-of-way <br />acquisition. Specific improvement details shall be submitted <br />for review and approval with any subdivision application. <br /> <br />12. A deferred improvement agreement for the applicant's pro-rata <br />share of curb/gutter/sidewalk, soundwall, landscaping along <br />the south side of Rose Avenue shall be entered into prior to <br />final map approval. These improvements shall be shown on the <br />tentative map. <br /> <br />13. <br /> <br />The applicant shall extend the existing 12 <br />the westerly boundary of the project site. <br />shall be shown on the tentative map. <br /> <br />14. The applicant shall be responsible for the undergrounding of <br />utilities along the site and their pro-rata share of the <br />entire undergrounding along Rose Avenue. Specific details <br />shall be submitted for review and approval with any <br />subdivision application. <br /> <br />16. A disclosure statement which informs all potential property <br />owners of the typical activities and potential impacts of the <br />Fairground to the south shall be recorded in all property <br />deeds. Specific details shall be submitted to the Planning <br />Director for review and approval prior to final map approval. <br /> <br />17. A homeowners association shall be formed with the <br />responsibility of maintaining the private driveway and <br />landscape improvements in good condition at all times. <br />Specific details shall be submitted for review and approval <br />with any subdivision application. <br /> <br />18. An access easement shall be granted to the adjacent property <br />owners (Jones and Thompson) on the final map. <br /> <br />19. The applicant shall extend the existing sewer line on Rose <br />Avenue to the westerly boundary of the site. This improvement <br />shall be shown on the tentative map. <br />
